Job Description
A Jurisdiction Liaison for quota bidding in sectors like mining, forestry, fishing, hunting, and treaty rights acts as a critical bridge between Indigenous nations/local governments, industry proponents, and regulatory bodies. They ensure that resource allocation aligns with treaty obligations, legal rights, and environmental regulations while facilitating economic development.
Core Skills
Regulatory & Treaty Knowledge: Deep understanding of Indigenous rights, environmental law (e.g., NEPA), and specific sector regulations.
Negotiation & Mediation: Ability to mediate between commercial interests and community rights during resource bidding.
Relationship Management: Building trust between government agencies, First Nations, and corporations.
Strategic Planning: Aligning long-term resource management plans with economic development goals.
Technical Proficiency: Understanding resource data,, spatial planning, and sustainability reports. Core Skills for Drafting Treaty-Related Contracts
Legal Knowledge: A deep understanding of treaty rights, including understanding of land stewardship, inherent rights to self-government, and the legal and moral basis for treaty fulfillment.
Precision in Language: Avoiding ambiguity by using precise, active voice; using "shall" for mandatory duties and "may" for rights.
Contextual Understanding: Incorporating the "spirit and intent" of the original treaties rather than just the literal text.
Consultation and Collaboration: The ability to work with Lands staff to determine how treaties apply to specific lands and to facilitate the exercise of these rights.
Duties:
Quota Bidding & Negotiation: Facilitating the acquisition of harvesting or mining rights, ensuring treaty obligations are respected.
Consultation & Engagement: Managing the consultation process between companies and Indigenous communities regarding potential impacts.
Regulatory Compliance: Ensuring all bids and operations comply with federal and local laws, including environmental assessments.
Benefit Agreement Management: Developing and overseeing agreements for resource benefit sharing, such as jobs, training, and community funds.
Data Management: Maintaining accurate records for public purposes, land use, and resource management.
Sector Specifics
Forestry/Mining: Coordinating with agencies on land use, sustainable harvesting, and environmental protection.
Fishing/Hunting: Managing quotas for marine or terrestrial resources, ensuring compliance with both federal and tribal regulations.
Treaty Rights: Ensuring that resource extraction does not infringe upon recognized, sovereign rights to hunt, fish, and gather. Duties in Treaty Contracts
Fulfilling the Trust Duty: Fulfilling obligations through actions, such as protecting habitats or enabling traditional practices, rather than mere documentation.
Government-to-Government Responsibility: Maintaining a formal, respectful relationship that recognizes sovereignty.
Protection of Rights: Clearly defining and protecting the specific rights reserved by the treaty (e.g., hunting, fishing, land use).
Cooperation: Working together to resolve potential conflicts. English-spoek fluent must, French-spoke or Spanish-spoke prefered.
